1. General

The following Terms and Conditions apply between Consumer ("you") and Hermance ("Hermance/we/us") and apply to all use of and orders on the website www.hermance.eu ("Website"). By using the Website and/or placing an order on the Website you confirm that you have read and accept the Terms.

We may change the Terms from time to time without notice. You are responsible for staying informed of changes to the Terms. Please note that the Terms and Conditions that apply to your order will always be the Terms and Conditions that were in effect at the time you placed your order, and not a later version. You should keep a copy of these Terms on your computer.

Access to this Website is permitted on a temporary basis. We reserve the right to withdraw or change the services without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period. From time to time, we may restrict access to some or all of this Website.

3. Terms of Sale

By placing an order you are offering to purchase an item subject to and subject to the Terms and Conditions. All orders are subject to availability and order price confirmation.

To place an order with Hermance you must be at least 13 years old, be a consumer (not a reseller) and hold a valid credit or debit card issued by a bank acceptable to us. When placing an order, you undertake that all information you provide to us is truthful and accurate.

3.1 Order Confirmation
When you place an order on our Website, we will send you an email confirming your order. The confirmation email is an acknowledgment that we have received your order, but is not an acceptance of your order.

3.2 Acceptance and Shipment Confirmation
All orders placed by you must be accepted by us. Once the order has been processed, you will receive a shipping confirmation email with all relevant information about your order. The shipping confirmation is our acceptance of your order.

3.3 Right to Refuse
We may, at our sole discretion, choose not to accept your order for any reason, without any liability to you. Examples of when we cannot accept your order include (but are not limited to):

• The ordered product is not in stock;
• Our inability to obtain payment authorization;
• The identification of an error in the product information, including price or promotion;
• If we suspect fraudulent activity;
• If there are shipping restrictions on a product.

If we are unable to deliver according to the terms of the confirmation, we will contact you and give you the opportunity to cancel the order. If we have already received the payment, we will refund you the amount.

3.4 Quality of the products
We strive to describe the articles on the Website as accurately as possible. However, due to different imaging, display technologies or other technical reasons, slight color differences and other variations in item(s) are possible. Hermance cannot be held responsible for such deviations.

4. Price and Payments

4.1 Price
The prices stated on the Website include Dutch VAT of 21%. The prices are stated in Euro (EUR) and are exclusive of service, payment and delivery.

The prices shown on the Website may vary from time to time. Hermance is not bound by the price until Hermance has accepted the order by sending you the shipping confirmation. Hermance reserves the right to change, limit or discontinue special offers or discounts at any time.

4.2 Price Changes
We always try to ensure that all prices on the Website are accurate, but errors may occur. If we discover an error in the price of one or more items ordered by you, we will notify you of the price change by email and give you the option of reconfirming your order at the correct price or canceling the order. If we are unable to contact you, your order will be cancelled. We are unable to compensate for price differences by placing orders or returning products.

4.3 Payments
We accept payments with iDeal, Visa, MasterCard, Paypal and Bancontact/Mister Cash.

When paying by card, you will be asked for the card number, the period of validity and the CVC code. We use MasterCard SecureCode and SSL encryption, which prevents unauthorized access to card details. We do not store card numbers after the transaction has been completed. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses or does not allow payment for any reason, you will be notified immediately at checkout.

4.5 Tax
Please note that local charges (customs duties, sales tax) may apply depending on your region and local customs duties. The costs are for your own account.

5. Newsletter Subscription Credit

5.1 Registration
Registration takes place via the special pop-up on the Hermance website or via the registration box in the footer. Once your e-mail address has been entered, you will receive a confirmation e-mail and once your e-mail address has been confirmed, you will receive the newsletter.

6. Delivery

6.1 Shipping Information
The shipping rates are applied per order. The exact shipping rates depend on the country where your order is delivered and the total amount of the order. All packages have a tracking number so that the package can be tracked. This tracking number will be shared in the shipping confirmation email.

If the shipping details are not fully and/or correctly provided by the customer or the package is refused, the return shipping costs and administration costs will be charged to the customer. Costs vary depending on shipping location. Shipping charges will apply for resending the package to the updated address. If you have entered incorrect shipping information, please contact our customer service at info@hermance.eu.

6.2 Delivery Time
We aim to deliver your order in Europe within 3-5 working days. For all countries outside Europe, we aim to deliver within 5 working days. If you have not received your order within the number of days indicated for your country in the "Shipping Information" table, please contact our customer service. Please note that we will not be held responsible for any delays due to postal delays.

7. Returns

7.1 Right of withdrawal
You have the right to withdraw within 14 days. To exercise this right, please send us a written request by e-mail. Because we process your order as soon as it is submitted, we may not be able to prevent shipment. Exceptions are only possible if we have not yet sent you the shipping confirmation, so please contact us if you wish to cancel your order to see if there is a possibility to cancel.

7.2 Right of return
You have the right to return purchased items within 14 days of purchase. To exercise this right, please send us an email stating the reason.

All original packaging with prizes and labels must be intact. No tape should be attached to the product or the packaging of the item. All items must be returned in a box to protect their shape. Returns that do not comply with our policies will not be accepted and we may charge you for shipping costs in case we need to send you the item(s) back.

For questions about your order, return shipment or the return form, please contact customer service.

7.3 Refund Information
All refunds will be paid within 30 days of the date we receive the returned product(s). We will pay you back through store credit, unless we agree another method with you; under no circumstances will you be charged for such refunds.

The shipping costs you may have paid with your order will not be refunded unless you have received an incorrect or damaged item.

8. Use of the Website

8.1 Errors, Inaccuracies and Omissions
Occasionally, there may be information on our Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, prices, promotions, offers, shipping charges and product availability. We reserve the right to correct any errors, inaccuracies or omissions at any time without notice; change or update information; or cancel orders if the information is incorrect.

8.2 Intellectual Property Rights
All elements on the Website are owned or licensed to Hermance and its affiliates. All elements of the Website, including (but not limited to) the content and photography, may be protected by copyright, moral rights, database rights, trademark and other intellectual property rights laws.

You may use this material for personal, non-commercial purposes only. You may download, print and store copies of this material for your own personal, non-commercial use. You may not publish, duplicate, distribute or otherwise reproduce the Content to others without Hermance's prior consent.

8.3 Limitation of Liability
Hermance is not liable for any indirect, direct, incidental or consequential damage that may result from the use or the content of our Website, including damage caused by viruses or any inaccuracy or incompleteness of the information on the Website; the performance of the products; or otherwise in connection with the use of these Terms, even if Hermance has been advised of the possibility of such damages.

8.4 Third Parties
On our Website, you may find third-party links that direct you to third-party websites that are not affiliated with us. We are not responsible for these links or for any loss or damage that may arise from their use. These websites have their own terms and conditions and privacy policies. Hermance is not responsible and cannot be held liable for the content and activities of these websites.

8.5 Invalidity
Each provision of the Terms shall be construed separately and independently of each other. If any provision is held to be invalid, void or otherwise unenforceable, such provision shall be deemed severable from and shall not affect the enforceability of the remaining provisions of these Terms.

By placing an order you agree and understand that we may collect, use, store and process your personal information in accordance with our Privacy Policy.

9. Applicable Law and Jurisdiction

These Terms are in accordance with the laws of the Netherlands. In the event of any dispute or claim relating to these Terms, such dispute or claim shall be subject to the exclusive jurisdiction of the Dutch courts.
